Assalamaulaikum brother. May Allah (s.w.t) grant us knowledge and wisdom. According to the hadith narrated by Anas Ibn Malik, the prescribed punishment for drinking alcohol or gambling is Fadjiliduhl (40 lashes). If the offender does not repent, the penalty is capital punishment/death penalty. However, this punishment can only be carried out by the government.
