Individuals under 21 are not allowed to use, possess, purchase, transport, grow, or consume cannabis for recreational purposes
What can Illinois residents possess?
Can possess up to 30 grams of cannabis flower
Can possess up to 5 grams of cannabis concentrate (oils, etc.)
Can possess up to 500 milligrams of cannabis infused product (gummies, brownies, etc.)
What can Non-Illinois residents possess?
Can possess up to 15 grams of cannabis flower
Can possess up to 2.5 grams of cannabis concentrate (oils, etc.)
Can possess up to 250 milligrams of cannabis infused product (gummies, brownies, etc.)
Where can a resident smoke or ingest cannabis products?
Cannabis can only be used in an individual’s private residence, as long as the residence is not used as a daycare and/or you are not in close proximity of someone under the age of 21.
Landlords and property owners have the authority to ban cannabis use on their properties.
Authorized locations licensed for cannabis consumption.
Where a resident cannot smoke or ingest cannabis products:
Vehicles
School grounds
Restaurants and bars
Public places including, streets, sidewalks, parks, playgrounds, and front porches, or (any place where a person could reasonably be expected to be observed by others).
Cannabis is prohibited in federally funded public housing
Correctional facilities
How can a resident transport cannabis?
In a vehicle it must be in an approved, sealed, odor-proof, and child-resistant container.
The cannabis must also be “reasonably inaccessible”.
Can a driver be arrested for DUI for being under the influence of cannabis?
Yes, under Illinois law if the driver is impaired. When a driver has 5 nanograms of THC in the blood, there is a presumption of impairment.
